Divorce between foreign residents
If both partners have the same nationality, they should divorce according to the laws of their home country. If they are of different nationalities, meaning they do not have the laws of a home country in common, and they are both normally resident in Japan, they should divorce according to Japanese law. If the laws applying to them accept divorce by mutual consent, they can submit a notification of divorce by mutual consent to their local municipal office in Japan. Should either of their home countries' laws not recognize divorce by mutual consent, however, their divorce will not be valid according to the laws of their home countries.
